    Emery & Milne Psychological Group, LLC strives to ensure that its digital services are accessible to people with disabilities.     The Widget offers user-triggered enhancements that allow visitors to improve the accessibility of the site. These features will, when selected, increase font size, pause animations, change color contrast, and more. People can choose combinations that suit their needs, as per WCAG Level AAA.


    The site has enabled Automated Remediation Technology (ART) for all visitors, whether they use assistive technology or not.   • Cancellation Policy

    Consistent attendance is necessary for a successful outcome. Scheduled appointments are reserved for you. Whenever possible, a courtesy text or email will be made to remind you or your appointment. However, you are ultimately responsible for keeping your appointments. 


    If an appointment is missed or canceled with less than 24 hours notice, you may be charged a no-show/late cancellation fee of $75. 


    In addition, if you arrive more than 10 minutes late for your scheduled appointment, your appointment will be considered a no-show/late cancellation and you will be charged the $75 no-show/late cancellation fee. 


    Payment of this fee is expected immediately upon being charged and receiving request for payment.

  • Communicable Disease Policy

    You understand that by coming to the office, you are assuming the risk of exposure to the coronavirus or any other public health risk including the common cold and flu. This risk may increase if you travel by public transportation, cab, or ridesharing service. If you and your provider have agreed to meet in person and there is a pandemic, or other public health risk, your provider may require that you meet via telehealth. If you have concerns about meeting through telehealth, your provider will talk about it with you first and try to address any issues. You understand that, if your provider believes it is necessary, they may determine that you should return to telehealth for everyone’s well-being on a permanent basis. To obtain services in person, you agree to take certain precautions which will help keep everyone including you, your provider, families, staff and other patients safe from exposure, sickness, and possible death. This includes symptoms of the common cold and flu. You are not to come to your session if you experience any symptoms that could possibly spread to another individual such as a cough, runny nose, fever, congestion and sneezing. If you do not adhere to these safeguards, it may result in starting or returning to a telehealth arrangement. Emery & Milne Psychological Group, LLC practice has taken steps to reduce the risk of spreading the coronavirus, or other public health risk, including the common cold and flu, within the office and we have posted our efforts on our website and in the office. Please let your provider know if you have questions about these efforts. You understand that Emery & Milne Psychological Group, LLC and your provider are committed to keeping you, your provider, staff, and patients and families safe from the spread of any illness. If you show up for an appointment and your provider or our office staff believe that you have a fever, or other symptoms, or believe you have been exposed to any illness, we will require you to leave the office immediately. A follow up with services by telehealth may be offered as appropriate. If your provider or our staff become ill, we will notify you so that you can take appropriate precautions. If you have tested positive for the coronavirus, or other public health risk, your provider may be required to notify local health authorities that you have been in the office. If your provider has to report this, your provider will only provide the minimum information necessary for their data collection and will not go into any details about the reason(s) for your visits.

  • Confidentiality

    The information disclosed by you is confidential and will not be released to any third party without written authorization from you except where required or permitted by law. Exceptions to confidentiality include situations where you pose a threat of serious harm to yourself or to someone else, cases involving suspected child, elder or dependent adult abuse, a court-order to testify or produce records, or as outlined in the “Notice of Privacy Practices.” If you participate in conjoint therapy sessions with family members, confidential information about your treatment will not be disclosed unless all person(s) who participate provide their written authorization to release such information. However, your provider may utilize a “no secrets” policy when conducting conjoint therapy sessions with family members. This “no secrets” policy may include revealing affairs, substance abuse problems, or intentions to leave a relationship. If you have questions about this “no secrets” policy and how it may affect you, please ask your provider.

    Professional Consultation and 


    Collaboration: 


    Professional consultation is an important component of a healthy therapy practice. As such, your provider regularly participates in clinical, ethical, and legal consultation with other professionals in addition to your provider. Your identification and personal information shall be protected. Your provider may need to collaborate with your physicians, psychiatrists, past providers, and other mental health professionals. If so, you will be asked to complete a release of information.


    Provider-Patient Privilege: 


    The information disclosed by you, as well as any records created, is subject to the provider-patient privilege. The patient is the holder of the provider-patient privilege. If you are concerned about waiving the provider-patient privilege in a legal proceeding, you should consult an attorney.   • Emergencies

    Although Emery & Milne Psychological Group, LLC and your provider have an afterhours emergency answering service, they are unable to provide continuous 24-hour crisis services. In the event of a medical emergency please call 911 to request emergency assistance or go to the nearest emergency room. In the event of a mental health crisis, please call 988 or go to the nearest emergency room. If you are a Veteran in crisis, please call 988 and select 1. You can also text 838255 or chat online here https://www.veteranscrisisline.net/get-help/chat.

  • Financial Policy

    Fees are due and payable at the time that services are rendered. You shall be responsible for the payment of fees for telephone sessions and consultations other than for scheduling purposes in accordance with the fee schedule below. Telephone sessions and consultations are to be paid in full immediately. Fees may be adjusted from time to time. You will be notified of any fee adjustment in advance. A copy of our current fee schedule is located in our new patient forms. Emery & Milne Psychological Group, LLC accepts insurance, debit, credit cards, cash and checks. Be advised that confidentiality cannot be guaranteed once a check has been deposited at the bank. Please note there will be a $50 service charge for any returned checks.

    Insurance


    Insurance companies handle behavioral health services differently than medical or surgical services. Therefore, we ask you to become as knowledgeable as possible about your own insurance plan and your own out of pocket expenses. We expect payment of your portion at the time of service. As a courtesy, Emery & Milne Psychological Group, LLC will file claims with your insurance company. Emery & Milne Psychological Group, LLC will bill the insurance company for you provided you have presented all required information. If your provider is contracted with your insurance company, your provider will accept as payment in full the insurance’s allowable amount. Please be aware that some services may not be covered according to your policy or you may have a deductible to meet before coverage is possible. You are ultimately responsible for payment of all services rendered and are responsible to notify Emery & Milne Psychological Group, LLC of any changes in your insurance policy or plan. You are also responsible to know your out-of-pocket costs for services as Emery & Milne Psychological Group, LLC makes no guaranty that services are covered under your plan prior to rendering services.


    Medicare


    Emery & Milne Psychological Group, LLC accepts Medicare assignment. This means Medicare will pay our office directly. If Emery & Milne Psychological Group, LLC or its provider is not contracted with your supplemental insurance company, Emery & Milne Psychological Group, LLC will bill your insurance one time as a courtesy. If a payment is not received within 30 days, you may be billed the balance up to Medicare’s allowable amount. If Medicare denies your services for medical necessity, you may be charged the full amount for services rendered.  


    VA Community Care Program


    If applicable, Emery & Milne Psychological Group, LLC will bill contracted services to the Veterans Administration (VA) and will accept as payment in full the VA’s allowable amount. Please be aware that some services may not be covered according to your authorization such as VA Disability, Social Security Disability, FMLA, and others evaluations as well as records requests by you or by an attorney. In addition, you are ultimately responsible for maintaining your VA benefits by attending required appointments and obtaining consults in order to secure authorizations for services.


    EAP


    Emery & Milne Psychological Group, LLC accepts various Employee Assistance Programs (EAP) for some therapy services. It is the policy of Emery & Milne Psychological Group, LLC to never complete paperwork related to your ability to work (FMLA, disability, etc.) while you are using your EAP benefits.

    9. CONTROLS FOR DO-NOT-TRACK FEATURES

    Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ( "DNT" ) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized . As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.


    California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

    Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system.     California "Shine The Light" Law

    California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.     14. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?

    Based on the applicable laws of your country or state of residence in the US , you may have the right to request access to the personal information we collect from you, details about how we have processed it, correct inaccuracies, or delete your personal information.   • Records Request Policy

    Privacy is a legal right, and protecting information gathered concerning our patient's care is a core value at Emery & Milne Psychological Group, LLC. Furthermore, our ethical and contractual obligation is to protect our patients' information, and they must agree to disclose any information we hold.  


    Records Held & Maintained 


    Emery & Milne Psychological Group, LLC and your provider keep electronic and paper records of services provided. Your provider may take notes during sessions and will document sessions afterward. These notes constitute their clinical and business records which, by law, they are required to maintain. Such records are the sole property of the provider. Should you request a copy of these records, such a request must be made in writing by completing a release of information form (see below). There may be a nominal charge. 


    Emery & Milne Psychological Group, LLC and your provider reserve the right, under Florida law, to provide you with a treatment summary in lieu of actual records. They also reserve the right to refuse to produce, under certain circumstances, a copy of records, but may, if requested, provide a copy of records to another treating health care provider. 


    Records are typically maintained for seven years following termination of therapy for adults. Records for children and adolescents will be maintained for seven years past their 18th birthday unless still in treatment. After seven years post treatment, records will be destroyed in a manner that preserves confidentiality.   


    Patient Requests


    To authorize us to disclose the details of your care with someone else (such as a family member or another healthcare professional), submit your request by completing our Release of Information form.


    Patients are entitled to request a copy of their records. If you are a current patient, please get in touch with your provider directly and complete our Release of Information form after speaking to them. If you are no longer a patient, submit our Release of Information form. However, if we determine that viewing your records would have a negative effect on you, we will discuss our decision and review them with you. Alternatively, documents may be sent to another mental health professional of your choice to allow them to review and discuss the contents with you.

    Third-party Requests


    ‍It is essential to know that consent requirements for mental health information are much more stringent than medical information. Therefore, the following conditions apply to mental health records in our possession:

    - Emery & Milne Psychological Group, LLC will not acknowledge that a patient is under our care via a request from a third party unless a written release from the patient is included.

    - A signed Authorization for the Release of Protected Health Information from the patient outlining the specific mental health records being requested must accompany all requests and subpoenas. If a signed authorization is unavailable, proof that the patient was notified and their right to object must be thoroughly documented.

  • Telepsychology/Telehealth Policy

    Telepsychology/Telehealth is an option at Emery & Milne Psychological Group, LLC. Telepsychology/telehealth includes the practice of health care delivery, including mental health care delivery, diagnosis, consultation, treatment, transfer of medical data, and education using interactive audio, video, and/or data communications. 


    Telepsychology/telehealth also involves the communication of your medical/mental health information, both orally and visually, to other health care providers. While using telepsychology/telehealth you maintain the right to withdraw consent at any time. The laws that protect confidentiality of your medical information also apply and remain confidential. However, the same limits of confidentiality apply as mentioned below under “Confidentiality” and in “Notice of Privacy Practices.” There are risks and consequences of using telepsychology/telehealth. These risks include, despite every reasonable effort will be made by your provider to ensure your information will be protected, the transmission of your medical information may be disrupted or distorted by technical failures, the transmission of your medical information may be interrupted by unauthorized persons, the electronic storage of your medical information could be accessed by unauthorized persons, and misunderstandings could occur between you and your provider. If you and your provider agree to use the telepsychology/telehealth for virtual sessions, your provider will explain how to use the platform. You need to use a webcam or smartphone during the session. It is important to be in a quiet, private space that is free of distractions (including cell phone or other devices) during the session. It is important to use a secure internet connection rather than public/free Wi-Fi. It is important to be on time. If you need to cancel or change your telepsychology/telehealth appointment, you must notify our office in advance by phone or email. You will need a back-up plan (e.g., phone number where you can be reached) to restart the session or to reschedule it, in the event of technical problems. If you are not an adult, you will need the permission of your parent or legal guardian (and their contact information) for you to participate in telepsychology sessions. You should confirm with your insurance company that the video sessions will be reimbursed; if they are not reimbursed, you are responsible for full payment. Your provider may determine that, due to certain circumstances, telepsychology/ telehealth is no longer appropriate.

    ‍Text messaging, including iMessage, is a very insecure and impersonal mode of communication. To protect you and Emery & Milne Psychological Group, LLC, our providers do not send or respond to text messages unless you consent to receive secure communications. If you have opted in to receive appointment reminders via text message, be aware these messages are automatically generated, and responses may not monitored or seen by staff.
